BOXINGIQ – TERMS OF SERVICE
1. Acceptance of Terms
By accessing or using BoxingIQ (the “Platform”), including any apps, websites, programs, content, or services, you agree to these Terms. If you do not agree, do not use the Platform.
2. Eligibility
You must be 18 years or older to use BoxingIQ unless expressly permitted otherwise. You represent that you are legally capable of entering into these Terms.
3. Nature of the Platform
BoxingIQ provides general educational and instructional content relating to boxing, fitness, performance, and mindset.
BoxingIQ does not provide medical, health, physiotherapy, psychological, or personalised professional advice. All content (including AI-generated content) is general in nature and not tailored to individual users. Users are solely responsible for deciding whether and how to apply any information.
4. Health, Fitness & Boxing Risk Disclosure
Boxing and physical training involve inherent risks, including injury, illness, or serious harm.
By using BoxingIQ, users confirm they are physically capable of participating, participate voluntarily and at their own risk, and accept responsibility for proper technique, equipment, training environment, and recovery. Users are advised to seek medical clearance before beginning any training program.
5. Assumption of Risk & Release
To the maximum extent permitted by law, users assume all risks arising from use of the Platform and release BoxingIQ, its owners, officers, contractors, and affiliates from liability for injury, loss, or damage arising from participation, except where liability cannot legally be excluded.
6. No Guarantees
BoxingIQ makes no guarantees regarding outcomes, results, fitness, performance, skill development, confidence, or any other benefit. Examples and testimonials are illustrative only.
7. AI & Automated Content
Some features may use automated systems or artificial intelligence. AI-generated outputs are informational only, may be incomplete or inaccurate, and must not be relied upon without independent judgment. BoxingIQ is not responsible for reliance on AI-generated content.
8. Accounts & Security
Users are responsible for maintaining the confidentiality of account credentials and all activity under their account. BoxingIQ may suspend or terminate accounts for misuse or breach of these Terms.
9. Payments, Subscriptions & Refunds
Fees and subscription terms are disclosed at purchase. Subscriptions renew automatically unless cancelled through the applicable platform. Refunds are governed by Australian Consumer Law and relevant app store policies. Except where legally required, payments are non-refundable.
10. Intellectual Property
All content and systems on the Platform, including programs, videos, audio, text, methods, frameworks, branding, and AI logic, are owned by BoxingIQ or its licensors. Users must not copy, distribute, sell, record, share, exploit, or derive competing products or systems from the Platform.
11. User Content
Users who upload content confirm they have the right to do so and grant BoxingIQ a non-exclusive, royalty-free licence to use that content for Platform operation and promotion. Users remain responsible for their content. BoxingIQ may remove content at its discretion.
12. Prohibited Use
Users must not use the Platform unlawfully or dangerously, misrepresent BoxingIQ, harass or harm others, or attempt to reverse engineer, scrape, or exploit the Platform.
13. Limitation of Liability
To the maximum extent permitted by law, BoxingIQ is not liable for indirect, incidental, or consequential loss. Total liability is limited to the amount paid by the user in the 12 months preceding any claim.
14. Consumer Law
Nothing in these Terms excludes rights under Australian Consumer Law that cannot be excluded.
15. Termination
BoxingIQ may suspend or terminate access for breach or misuse. Upon termination, the user’s right to use the Platform ends immediately.
16. Changes to Terms
BoxingIQ may update these Terms from time to time. Continued use constitutes acceptance of the updated Terms.
17. Governing Law
These Terms are governed by the laws of Queensland, Australia. Users submit to the non-exclusive jurisdiction of its courts.
Order of Priority Clause:
In the event of any inconsistency between these BoxingIQ Terms of Service and any other terms (including developer, hosting, or technical service terms), these BoxingIQ Terms govern the relationship between BoxingIQ and the user.
